2. Definitions
- Linca Application – a mobile application provided by the Provider, used for receiving redirected calls, creating summaries, and optionally recording and transcribing calls.
- User – a natural or legal person who downloads and uses the application.
- Summary – a text message generated by the AI assistant containing a recap of a phone call.
- Subscription – a weekly recurring payment for using the service through the Apple App Store or Google Play Store.
3. Contract Formation and Order Process
- The contract between the User and the Provider is concluded at the moment the User confirms the subscription order in the App Store or Google Play.
- Before confirmation, the User has the option to check and, if necessary, correct the entered data.
- The contract is concluded in the Czech language. The Provider does not archive the contract text; however, the terms are always available in the application.
- Information about the price, features, and duration of the subscription is clearly stated on the subscription page in the application as well as in the App Store/Google Play environment.
4. Service Nature
- The service is an OTT (over-the-top) service, not an electronic communications service.
- The User sets up call forwarding with their mobile operator to the service number.
- The AI assistant answers the call, informs the caller that it is an AI, determines the purpose of the call, and creates a Summary.
- The Summary is delivered to the User in real time in the application.
- The User acknowledges that the mobile operator may charge fees for call forwarding, including roaming. These fees are always borne by the User.
5. User Obligations
- The User must set up the service in accordance with the application instructions.
- The User is responsible for compliance with the legal regulations in their jurisdiction.
6. Price and Payment Terms
- A new User receives 3 Summaries for free.
- Further use of the service is subject to a weekly subscription.
- The subscription renews automatically until the User cancels it in the App Store/Google Play.
- Before confirming the order, the User is clearly informed about the recurring nature of the payment.
- Payments are handled by the App Store and Google Play as the merchant of record, including processing complaints and refunds.
- The Provider reserves the right to change the price and scope of service features. The User will be informed of such a change at least 14 days before it takes effect and has the right to reject it by terminating the subscription.
7. Fair Usage Policy – Unlimited Plan
- The Unlimited Plan (“unlimited summaries”) is intended for normal everyday use by an individual or a small business.
- Use of the service in a manner corresponding to bulk or call center operations is not permitted.
- If the Provider detects excessive service load in such a way, it may contact the User, notify them, and reasonably limit or adjust the provision of the service to maintain quality for all Users.
- This does not affect the consumer’s statutory rights.
8. Consumer Right of Withdrawal
- The consumer has the right to withdraw from a distance contract within 14 days of its conclusion.
- If the consumer requests immediate performance, they acknowledge that in case of withdrawal they must pay a proportional part of the price.
- If the service is fully provided based on explicit consent, the right of withdrawal ceases (§ 1837(a) Civil Code).
- Withdrawal may be made:
- by sending a form or an unambiguous statement by email to the Provider’s contact address,
- via the account in the application,
- via chat in the application, or
- by another unambiguous statement made to the Provider.
9. AI Transparency
- The AI assistant always states at the beginning of a call: “I am an AI assistant.”
- In case a user sets their own caller greeting, they must clearly state it’s an AI assistant.
10. Limitation of Liability
- The Provider is not liable for:
- inaccuracies in AI-generated Summaries,
- service unavailability caused by third parties,
- fees charged by the mobile operator.
- This does not affect consumer rights or the Provider’s liability for damage caused intentionally, by gross negligence, or harm to natural rights (§ 2898 Civil Code).
11. Dependence on Third Parties
The service uses third-party technologies (e.g., OpenAI, ElevenLabs, Twilio). By using the service, the User acknowledges the terms of these providers.
12. Out-of-Court Dispute Resolution
- The consumer has the right to file a complaint with the Czech Trade Inspection Authority, Štěpánská 15, 120 00 Prague 2, www.coi.cz.
- The consumer may use the EU ODR platform: https://ec.europa.eu/consumers/odr/.
13. Prohibited Use
The User must not use the service for:
- fraudulent or deceptive purposes,
- providing medical or financial advice without human oversight,
- generating or distributing content in violation of legal regulations.
14. Termination and Suspension of Service
- The Provider may terminate or suspend the service in case of non-payment, abuse, or breach of these terms.
- In the event of unilateral changes to the contractual terms, the User has the right to terminate the contract without penalty.
15. Governing Law and Language
- These terms are governed by the laws of the Czech Republic.
- Consumers outside the Czech Republic are not deprived of mandatory rights under their country of residence (Rome I Regulation, Brussels I bis).
- The Czech version of the terms is decisive.
16. Changes to the Terms
- The Provider is entitled to change these terms.
- The User will be informed of the change at least 14 days before it takes effect via the application or email.
- If the User disagrees with the change, they have the right to terminate the contract.
